Terms of service

These terms apply when you buy from or use iykezachariah.store (the store), operated by Iyke Zachariah from Western Australia, Australia. By placing an order or using the store, you agree to these terms. If you do not agree, please do not use the store.
What I sell
Everything in this store is a digital product: colour grading LUTs, PowerGrades, wallpapers and similar downloadable files, along with any written or video material included with them. Nothing is shipped physically.
Delivery
Your download is delivered by email and by an on-screen link once your payment is confirmed. If your download does not arrive, or a file will not open, email contact@iykezachariah.com and I will sort it out.
Please check that your software and hardware can use a product before you buy it. Each product page lists the software the product is built for.
Your licence
When you buy a product you get a single-user, non-exclusive, non-transferable licence to use it. You may:
- Use the product on your own projects, including paid client work
- Install it on the devices you personally use
You may not:
- Share, resell, sublicense, rent or redistribute the files, in whole or in part
- Include the files in another product, preset pack or template, whether sold or given away
- Upload the files anywhere other people can download them
- Present the product as your own work
I keep ownership and copyright of every product. The licence lets you use the files, it does not transfer ownership to you. If you breach these licence terms, the licence ends immediately.
Prices and payment
Prices are shown in Australian dollars unless your browser is showing another currency. Where another currency is shown, the conversion happens at checkout and the final amount charged can vary slightly with exchange rates and your bank's fees. Payment is handled by Shopify and its payment providers. I do not see or store your card details.
I can change prices, and start or end promotions, at any time. Changes never apply to an order you have already placed.
Refunds
Digital products are covered by my Returns and Refund Policy. Please read it before buying.
Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
My goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a replacement or a refund, and to compensation for any other reasonably foreseeable loss or damage. If the failure is not major, you are entitled to have the problem fixed within a reasonable time, and if that does not happen, to a refund.
Acceptable use
Do not use the store to break the law, to infringe anyone's rights, to interfere with how the site runs, or to try to reach systems or accounts that are not yours.
Accounts
If you create an account, keep your login details secure. You are responsible for what happens on your account. Tell me straight away if you think someone else has access to it.
Availability
I aim to keep the store and its downloads available, but I cannot guarantee uninterrupted access. The store can be unavailable during maintenance, or because of a problem with Shopify or another provider I rely on. Products can be changed or discontinued at any time.
Third party services
The store links to and relies on third party services, including Shopify, payment providers and file hosting. Their own terms and privacy policies apply when you use them. I am not responsible for third party content.
Liability
Subject to your rights under the Australian Consumer Law, and as far as the law allows, my liability for any claim connected to a product or to the store is limited to resupplying the product or refunding what you paid for it. I am not liable for indirect or consequential loss, including lost profits, lost data or loss of business.
Privacy
How I collect and handle personal information is set out in my Privacy Policy.
Changes to these terms
I may update these terms from time to time. The version published here when you place an order is the version that applies to that order.
Governing law
These terms are governed by the laws of Western Australia, Australia, and are subject to the non-exclusive jurisdiction of the courts of Western Australia.
